Public Advisory for the Retrenchment/ Temporary Lay-Off/ Closure of Businesses or Organisations

At this time, the Ministry of Labour and Small Enterprise Development would like to advise ALL EMPLOYERS currently engaging in retrenchment and temporary lay-off exercises due to the Coronavirus /COVID-19 Pandemic to report such activity to the Minister of Labour and Small Enterprise Development using the underlying format.

Retrenchment:
Pursuant to Section 4 of the Retrenchment and Severance Benefits Act, Chapter 88:13, employers are advised to report ALL instances of retrenchment as follows:

(a) the names and classifications of the involved workers;
(b) the length of service and current wage rates of the involved workers;
(c) the proposed date of the termination of employment;
(d) the criteria used in the selection of the workers to be retrenched;
(e) and any other relevant information.

Temporary Lay-Off:
Where an employer has conducted a ‘Temporary Lay-Off’ exercise, the Ministry of Labour and Small Enterprise Development is requesting that such information be reported to the Minister of Labour and Small Enterprise Development as well. It should identify the following:

(a) the name of the business;
(b) the names and classifications of the involved workers; and
(c) the intended date of return

Closures or Intended Closure of Business:
In instances where there is a closure of business or intended closure, the Ministry of Labour and Small Enterprise Development is requesting that such information be reported to the Minister of Labour and Small Enterprise Development. It should identify the following:

(a) the name of the business;
(b) the names and classifications of the involved workers; and
(c) the date of closure

Please note that organisations that would have submitted requests for Social Assistance for workers affected by the restrictions associated with the COVID-19 Pandemic, are also required to submit the necessary information concerning any temporary lay-off, retrenchment and any closure or intended closure of business to the Ministry of Labour and Small Enterprise Development at This email address is being protected from spambots. This has become necessary to accurately record the number of persons adversely affected by the COVID-19 Pandemic and the subsequent restrictions implemented.
